Disclosure failures played a major part in a case called Powell v Watford Borough Council. Parties are often pilloried for shortcomings in the content of their lists through inadequate or incomplete searches. The rules also cover the form and substance of the list, and (among other defects) a letter simply reciting that someone had made a search was not enough. The defence was struck out. Read more
